| Legislative Summary | In 1998 Utah passed enabling legislation as part of the Schools for the 21st Century Act (HB 145) that allows the State Board of Education to grant up to eight charter schools for a three-year pilot project. Either a new or existing school can be created. The proposal can come from an individual or groups (at least 2/3 of certified educators and parents at conversion schools must sign a petition with the percentage reduced to a simple majority if the conversion is only for a portion of an existing school). Waivers from state board rules must be applied for individually. Teachers must be certified or qualify under alternative certification or authorization programs. State funding is comparable to other public schools. Charter schools must participate in the statewide assessment system and core curriculum assessments, corresponding to the state-adopted core curriculum.
